AUBURN — A Cayuga County Court judge ruled Tuesday that a former Auburn Community Hospital employee must pay $100,000 in restitution after stealing medical items there and selling them on eBay.
Zachary P. Tabone, 33, was placed on one year of interim probation by Judge Jon Budelmann that afternoon for second- and third-degree grand larceny.
Tabone's attorney, Dennis Sedor, told Ë®¹ûÅÉAV after court that his client pleaded guilty to the charges in late April and now must pay $100,000 in restitution by his sentencing date of May 5, 2026. If Tabone pays that amount by then, he will be sentenced to five years of probation, with one year already served. If he doesn't, the Cayuga County District's Attorney's Office can recommend incarceration.
Tabone is also in counseling for gambling addiction, Sedor said, and receiving support from friends and family.Â
As reported by Ë®¹ûÅÉAV in February, Tabone stole a total of $83,748.06 in medical items like flu tests and thermometer probes while serving as the hospital's lead stockroom clerk from 2021 to 2023. Hospital employees contacted police after noticing a bill of more than $7,500 on its UPS account, which he used to ship hundreds of stolen items to eBay customers in fall 2023.
Tabone was arrested on the Class C and D felony larceny charges in July 2024, and arraigned on a grand jury indictment earlier this year.
Sedor said police ultimately determined Tabone stole more than $100,000 in items. Budelmann said Tuesday that along with paying that amount by his sentencing date, he needs to stay out of trouble.Â
