The court appearance of Cayuga County Clerk-elect Brian Scanlan — who crashed into a parked car in Owasco and left the scene days after winning election this month — has been postponed.Â
Scanlan was due to appear in Owasco Town Court on Tuesday for the violation. However, a note posted on the door of town hall announced that all the evening's cases were adjourned to Tuesday, Dec. 12.
Meanwhile, the owner of the home where the Nov. 11 crash took place has asked Cayuga County District Attorney Brittany Grome Antonacci to appoint a special prosecutor to investigate it.Â

Attorney Joe Camardo, of 12 Fairway Drive, made the request following a Nov. 22 meeting with Grome Antonacci and members of their staffs. He followed up with a Nov. 24 letter, a copy of which was provided to Ë®¹ûÅÉAV on Tuesday. But in a response sent Wednesday, a copy of which was also provided to Ë®¹ûÅÉAV, the district attorney said there is no basis to appoint a special prosecutor.
County law provides for the appointment of a special prosecutor when the district attorney is "disqualified," Grome Antonacci noted, but she has not identified any such disqualification.
"Upon our independent review of the matter, the only offense supported by the available evidence is the offense charged," she wrote.
In his letter, Camardo said he believes a special prosecutor is necessary because law enforcement has been "thwarted" in its efforts to investigate the crash, leaving many unanswered questions.
"I believe your efforts have also been compromised dramatically because of a lack of facts and information," he told Grome Antonacci.

Those questions, Camardo said, are based on information he has received from sources, whom he did not name. The questions include whether Scanlan was leaving a party down the street when he crashed into the parked car; whether Scanlan was drinking or doing drugs beforehand; and whether any law enforcement officials were at the party and helped thwart the investigation.Â
Cayuga County Sheriff Brian Schenck previously told Ë®¹ûÅÉAV that officers interviewed residents of a nearby home. They denied knowing who was driving the red truck reported as crashing into the car, Schenck said, which was later confirmed to be Scanlan's. In his letter, Camardo said officers did not get more information on the party's attendees so that they could be interviewed later.Â
Body camera footage of the interview was reviewed at the meeting between Camardo and Grome Antonacci, she noted. The interview was conducted by New York State Police, assisting the sheriff's office.
"I share your frustration with the apparent lack of forthrightness of those individuals,"Â she told Camardo. "As you can imagine, it is a routine experience for prosecutors and police officers to be confronted with the reluctance or unwillingness of witnesses to cooperate. However, consistent with the Fifth Amendment, individuals may not be compelled to speak to law enforcement."Â
Camardo also raised questions about the accident itself with the district attorney. He said Scanlan may have driven through a stop sign, at "excessive" speed, and then returned to the scene later.Â
The parked car belonged to Dr. Cyndy King, of North Carolina, who was in town for the funeral of Camardo's mother that weekend. King told Ë®¹ûÅÉAV her car, a Subaru, was a total loss.
Camardo previously told Ë®¹ûÅÉAV he intends to pursue civil action against Scanlan as well, saying King is "traumatized" by the accident.
Scanlan has not responded to a request for comment on the accident by Ë®¹ûÅÉAV. His attorney, Scott Brenneck, did not respond to a request for comment Wednesday morning.
A retired Auburn firefighter, Scanlan won election to the county clerk's office Nov. 7 with 42.6% of the vote. The independent, endorsed by the Cayuga County Democratic Committee, defeated Conservative candidate Kristine Lytle and Republican candidate Chris Petrus after a competitive three-way race. Scanlan will succeed Sue Dwyer, the clerk for the last 20 years, in January.
